Filing and Maintenance Requirements
The Maternity Benefit Act, 1961 (“Maternity Act”) applies to every establishment in which 10 (ten) or more women are employed or were employed on any day of the preceding 12 (twelve) months of expected delivery. Registers are to be maintained in respect of the maternity benefit provided.
Under Section 21 of the Maternity Act, if any employer contravenes the provisions of the Maternity Benefit Act or the rules made there under, he is punishable with (a) imprisonment, which shall not be less than 3 (three) months but may extend to 1 (one) year, or (b) with fine, which may not be less than Rs. 2000 (Rupees Two Thousand) but may extend to Rs. 5000 (Rupees Five Thousand) or (c) with both.
