Filing and Maintenance Requirements
The Company is also required to (a) file quarterly returns with the authorities in Form XXVII; (b) maintain (i) Register of employment in From XXII; (ii) Register of Wages in Form XXIII; (iii) Register of leaves in Form XXV; (iv) notice in Form XXIV specifying the holidays; (v) register of advances in Form XII (if any advances have been given by the Company); and (vi) register of deductions for damages or loss in Form XI (if any deductions for damages or loss have been made by the Company).
Section 61 (2) of the Shops and Establishments Act provides that any employer who fails to file the returns or maintain the records and registers as required by the Act shall, for a first offense with fine which may extend to Rs. 100/- (Rupees One Hundred only), for a second offense with fine which shall not be less than Rs. 250/- (Rupees Two Hundred Fifty only) but which may extend to Rs. 500/- (Rupees Five Hundred only) and for third and subsequent offense with imprisonment for a term which may extend to 3 (three) months and with a fine which shall not be less than Rs. 500/- (Rupees Five Hundred only) but which may extend to Rs. 1,000/- (Rupees One Thousand only).
