    Public Liability Insurance Act, 1991 (“Public Liability Act”) The object of the Public Liability Act is to provide through insurance immediate relief to persons affected due to accident while handling hazardous substance by the owners on no fault liability basis. Where death or injury to any person (other than a workman) or damage to any property has resulted from an accident, the Public Liability Act mandates that the owner is liable to give relief to such person as specified by the Act. The Public Liability Act requires the owner to take out insurance policies before he starts handling any hazardous substance whereby he is insured against liability to give such relief.

  • Penalty

    Where any offence under this Act has been committed by a company, every person who, at the time the offence was committed, was directly in charge of, and was responsible to, the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly.
